AI Pic Magic is an AI-powered video generation platform that allows users to create videos from text prompts, images, and reference content. The Service is provided on a pay-as-you-go credit basis or through subscription plans.
3. Account Registration
To use our Service, you must:
- Be at least 13 years of age
- Provide accurate, current, and complete information during registration
- Maintain the security of your account credentials
- Accept responsibility for all activities that occur under your account
- Notify us immediately of any unauthorized use of your account
4. Credits and Payments
4.1 Credits
Our Service operates on a credit system. Credits are purchased with real money and are consumed when you generate videos. The number of credits required for each generation depends on the model, duration, resolution, and output number.
4.2 Credit Expiration
Credits may expire based on the type of credit package purchased. Free trial credits typically expire after 30 days, while purchased credits may have different expiration periods.
4.3 No Refunds
All credit purchases are final and non-refundable, except as required by law. Credits cannot be exchanged for cash or transferred to another account.
4.4 Subscription Plans
We offer subscription plans that provide recurring credits. Subscriptions automatically renew each billing period unless cancelled. You may cancel your subscription at any time, but cancellations will take effect at the end of the current billing period.
5. Acceptable Use Policy
You agree not to use the Service to:
- Generate illegal, harmful, or offensive content
- Violate any applicable laws or regulations
- Infringe on intellectual property rights of others
- Generate deepfakes of real people without consent
- Spread misinformation or propaganda
- Generate violent, sexually explicit, or hateful content
- Attempt to circumvent usage limits or credit systems
- Reverse engineer or attempt to extract our AI models
6. Content and Intellectual Property
6.1 Your Content
You retain ownership of the content you provide, including prompts, images, and generated videos. By submitting content, you grant us a license to use, store, and process it solely for providing the Service.
6.2 Generated Content
You own the videos you generate using our Service, subject to these Terms. However, we do not claim ownership of generated content and do not guarantee that generated content will be unique or free from similarity to other users' content.
6.3 Our Intellectual Property
The Service, including all technology, software, and AI models, is owned by AI Pic Magic and protected by intellectual property laws. You may not copy, modify, or distribute our technology without permission.
7. Service Availability
We strive to provide reliable service but do not guarantee uninterrupted access. We may temporarily suspend the Service for maintenance, updates, or other reasons. We are not liable for any losses resulting from service interruptions.
8. Termination
We reserve the right to suspend or terminate your account at any time, with or without notice, for any reason, including but not limited to violation of these Terms. Upon termination, your right to use the Service will immediately cease.
9. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
10. Limitation of Liability
AI PIC MAGIC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR CREDITS IN THE TWELVE MONTHS PRECEDING THE CLAIM.
11. Indemnification
You agree to indemnify and hold harmless AI Pic Magic from any claims, damages, losses, liabilities, and expenses arising from your use of the Service or violation of these Terms.
12. Changes to Terms
We may modify these Terms at any time. Continued use of the Service after changes constitutes acceptance of the new Terms. We will notify users of significant changes via email or through the Service.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which AI Pic Magic is established, without regard to its conflict of law provisions.
